Need help wording a copyright infringement disclaimer?

I’ve put together a site advertising my photography services. It’s a free service where I photograph their event/portrait/etc and they receive a free CD with their digital photos on it and then if they want to order prints, I give them a discounted price. But on the site I want to include something about how the digital photos on the CD will contain a small watermark at the bottom and that they can’t have them printed at Wal-mart or CVS, etc because it would be copyright infringement. How should I word this? Example?

Are you sure you want a “disclaimer”? A disclaimer, as the name implies, generally refers to a disclaimer of rights and/or liabilities. From your question, it doesn’t sound like you want to disclaim your copyright, but rather some sort of Terms of Service notifying others of your rights under the copyright laws.

As a practical matter, you can word your Terms of Service any way you want. You might want to look at the Terms of Service of similar websites. Keep in mind, however, that Terms of Service have very little, if any, legal effect with regards to copyright. More importantly than the Terms of Service, I would suggest including a proper copyright marking (i.e., the circle C) on the works you distribute.
